Terms of Service
Effective October 13, 2026 · Last updated October 13, 2026 · Version 2026-10-13
1. Agreement to these Terms
These Terms of Service ("Terms") are an agreement between you and Triple Threat Ventures, Inc., a California corporation ("Triple Threat", "we", "us"). They govern your use of the Triple Threat platform, including the Breakaway apps, our websites and our APIs (together, the "Service").
By creating an account, signing in with Google or Apple, or otherwise using the Service, you agree to these Terms and confirm you have read our Privacy Policy, which explains how we handle your information. If you don't agree, don't use the Service.
2. Who can use the Service
- You must be at least 16 years old.
- If you are under 18, your parent or legal guardian must review and agree to these Terms on your behalf. They are responsible for your use of the Service, including any subscription charges.
- Agents, agency staff and anyone using the Service for a business must be at least 18 and have authority to accept these Terms for that business. "You" then includes the business.
- You may not use the Service if we have previously terminated your account, or if the law where you live prohibits it.
If we learn that someone under 16 has an account, or that a user under 18 doesn't have a parent or guardian's agreement, we may suspend or delete the account.
3. Your account
You can create an account with an email address and password, or by signing in with Google or Apple. Give us accurate information and keep it up to date. You are responsible for activity under your account and for keeping your sign-in credentials secure. Tell us promptly at team@support.triplethreat.co if you think someone else has accessed it.
Access to new accounts may require an invite code while we grow. Without one, you can join a waitlist. Invite codes are personal to the people we or our partners give them to, and we may revoke a code that is shared or misused.
4. What the Service does
Triple Threat helps athletes and creators run their careers like a business. Depending on your plan, the Service includes brand analysis and reports, content planning and AI-generated content ideas, social media analytics for accounts you connect, contract upload and AI review, deal and partnership tracking, goal tracking, an AI coach, media kits, and tools for agents and agencies to support the athletes they represent.
We change and improve the Service over time. We may add, change or remove features, and we'll give reasonable notice before removing a feature that is central to a paid plan.
5. AI features and their limits
Many features use artificial intelligence to analyze what you provide and to generate suggestions, summaries, scores and content. AI output can be incomplete, out of date or wrong. Review it before relying on it.
The Service does not provide legal, financial, tax, investment or NIL-compliance advice, and using it does not create an attorney-client, fiduciary or agency relationship. We are not a law firm, a financial adviser or a licensed athlete agent. Contract analysis flags terms for you to discuss with a qualified professional; it is not a legal opinion.
You are responsible for your decisions and for complying with the rules that apply to you, including name, image and likeness (NIL) rules set by your school, athletic association, league or state, and disclosure rules for sponsored content.
6. Your content
"Your Content" is what you put into the Service or connect to it: profile and onboarding answers, contracts and other files, deal details, messages to our AI coach, check-ins and goals, and data from social accounts you connect. You keep all ownership rights in Your Content.
You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, analyze, transmit and display Your Content only as needed to operate and provide the Service to you and to the people you choose to share with, to keep the Service secure, and to comply with the law. This includes sending it to the service providers listed in our subprocessor list to process it for us. The license ends when Your Content is deleted from the Service, except for copies we must keep as described in the Privacy Policy.
We do not sell Your Content, use it for advertising, or use your contracts or private content to train AI models. We may use information about how the Service is used, and generic patterns that don't identify you (for example, the name of a content theme many athletes adopt), to improve the Service.
You confirm you have the rights needed to upload and share Your Content, and that doing so doesn't violate any law or agreement. That matters for contracts in particular: many include confidentiality clauses that limit who you may share them with. Check yours before uploading. Contracts usually contain other people's information too, such as the names and contact details of brand staff; only upload what you are entitled to share.
7. How we keep your content confidential
We treat the contracts you upload, your deal terms and financial details, your conversations with our AI coach, and your other non-public content as confidential. We use them only to provide the Service to you, and we disclose them only:
- to our service providers, who process them on our behalf under obligations of confidentiality and data protection;
- to people you authorize, such as an agent or agency you link to your account;
- when the law, a court or a government authority requires it, in which case we'll tell you first where we lawfully can; or
- as part of a merger, acquisition or sale of our business, to a successor bound by these same obligations.
We protect confidential content with reasonable administrative, technical and physical safeguards. No system is perfectly secure, and we can't guarantee that unauthorized access will never happen. If a breach affects your information, we'll notify you as the law requires.
9. Connected social accounts and third-party services
You can connect Instagram, TikTok and other accounts so we can show you analytics about them. We access only what the permissions you grant allow, and you can disconnect at any time. Your use of those platforms remains subject to their own terms, and their features and data access can change without notice to us.
The Service relies on third parties, including Stripe for payments and Google and Apple for sign-in. Their services are governed by their own terms and privacy policies, and we aren't responsible for them.
10. Subscriptions, trials and billing
Automatic renewal. Paid plans are subscriptions that renew automatically until you cancel. We charge the payment method on file at the start of each billing period. The price and billing period are shown before you subscribe. After you subscribe, we email you a confirmation of these terms, including how to cancel. Payments are processed by Stripe; we don't store your full card number.
Free trials. When a free trial is offered, you enter a payment method to start it, and you are not charged until the trial ends. Unless you cancel before then, your subscription starts automatically and you are charged the plan price. Each person can use one free trial.
Cancelling. You can cancel online at any time in Settings, through the Manage subscription link, or go directly to the billing portal at /checkout/manage. Cancellation takes effect at the end of the current billing period, and you keep access until then. If you cancel during a free trial, you won't be charged.
Refunds. Except where the law requires otherwise, payments are non-refundable, and we don't give credits for partial billing periods or unused features.
Price changes. We'll give you at least 30 days' notice before a price change applies to your subscription, and you can cancel before it takes effect.
Sponsored and enterprise accounts. If an agency pays for your seat, it is billed under its own agreement with us. Your account and Your Content remain yours. If you accept a sponsored seat while you have your own subscription, we cancel your subscription at the end of its current billing period, without a refund for the rest of that period. If the sponsorship ends, you can keep using the Service by subscribing yourself. Enterprise customers are bound by their order form, which controls if it conflicts with these Terms.
Taxes and failed payments. Prices exclude taxes unless stated. If a payment fails, we may limit paid features until it is resolved.
11. Acceptable use
Don't, and don't help anyone else to:
- break the law or violate anyone's rights, including privacy and intellectual property rights;
- upload content you don't have the right to share, or that is unlawful, harassing or deceptive;
- access accounts or data that aren't yours, or try to bypass security or usage limits;
- scrape, copy or resell the Service, or reverse engineer it except where the law allows;
- upload malware or disrupt the Service or the systems it runs on;
- use the Service to build a competing product, or use its outputs to train AI models;
- impersonate anyone or misrepresent your affiliation with an athlete, agency or brand.
We may remove content or limit access to protect the Service, our users or others.
12. Our intellectual property and your feedback
The Service, including its software, design, text, graphics and the Triple Threat and Breakaway names and logos, belongs to us or our licensors and is protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use the Service under these Terms. AI output generated for you is yours to use, subject to these Terms and to the rights of others.
If you send us feedback or suggestions, we may use them without restriction or payment to you.
13. Copyright complaints
If you believe content on the Service infringes your copyright, email team@support.triplethreat.co with: your contact details; a description of the copyrighted work; where the material appears on the Service; a statement that you have a good-faith belief the use isn't authorized by the owner, its agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove the material and terminate repeat infringers.
14. Ending your use of the Service
You can stop using the Service at any time, and you can delete your account in Settings. Deleting your account cancels any personal subscription and erases your data as described in the Privacy Policy.
We may suspend or terminate your access if you materially breach these Terms, if we must for legal reasons, or if your use creates risk for us or others. Where reasonable, we'll tell you why and give you a chance to fix the problem first. If we end the Service or your access without cause, we'll refund any prepaid fees for the unused period.
Sections that by their nature should survive termination do, including Your Content (license end), confidentiality, disclaimers, limitation of liability, indemnity and disputes.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T PROMISE THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI OUTPUT WILL BE ACCURATE, OR THAT USING THE SERVICE WILL LEAD TO ANY PARTICULAR DEAL, INCOME OR AUDIENCE GROWTH. SOME JURISDICTIONS DON'T ALLOW THESE EXCLUSIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.
16. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, NEITHER WE NOR OUR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DEALS, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.
These limits don't apply to liability that can't be limited by law, including liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our negligence.
17. Indemnity
To the extent the law allows, you will defend and indemnify us, and our officers, employees and agents, against third-party claims, and the resulting losses and reasonable legal fees, arising from Your Content or from your violation of these Terms or of the law. We'll promptly tell you about any such claim and let you control its defense, and we may join with counsel of our own choosing at our own cost.
18. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing a claim, please email team@support.triplethreat.co and give us 30 days to try to resolve it informally.
Any dispute that isn't resolved informally will be decided exclusively by the state or federal courts located in the State of California, and you and we consent to their jurisdiction. Either of us may bring a qualifying claim in small claims court instead. If you are a consumer living outside the United States, you also keep the protection of your local law and courts where the law requires it.
19. Changes to these Terms
We may update these Terms. Each version has an effective date, and we keep earlier versions available. If a change is material, we'll tell you by email or in the Service before it takes effect and, where the law requires, ask you to accept it. If you keep using the Service after a change takes effect, the updated Terms apply. If you don't agree, stop using the Service and delete your account.
20. General
These Terms, the Privacy Policy and any order form or plan terms you agree to are the whole agreement between you and us about the Service. If a provision is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not assign these Terms without our consent; we may assign them to a successor in a merger, acquisition or sale of assets. Neither of us is liable for delays caused by events beyond reasonable control.
Notice to California residents. Under California Civil Code Section 1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
